Court satisfied with evidences, No future of the tax evasion case against Australian victim

The appellant, Mr. Shank Kaye is an Australian resident. Last year in the month of September, he was baselessly accused for deceitful purchase of Condomium that was worth for P14 million.

Having good faith on his ex-lawyer, he had finalized the deal of purchase for which his lawyer had told him that its title was free from liens. He was totally not aware of the fraudulent deal that caused the entire mess. He had all the evidences with him which were correct, true and satisfied the Court as well. There wasn’t any single support which could go against his innocence as it was a genuine deal that was based on legal trust and the client was misguided by his ex-lawyer.

This case was filed by the BIR – Bureau of Internal Revenue which is responsible for collection of revenue in Australia. They had charged Mr. Shank Kaye for tax evasion in which the authorities said that they had already sent a notice to the victim which was ignored by him. They even told that Shank was well aware of the fake documents, which was not so true.

However, Shank had all the evidences with him to prove his innocence and he was highly supported by his lawyer Aldave who told the reports about the actual truth. Aldave revealed truth before the court and proved that he along with his client were a victim of trial by publicity as they both learned about the complaint filed by the Bureau of Internal Revenue from the media only.

Neither Aldave nor shank had received any notice prior to the case. Only after the court received the real evidences, it was notified that Mr. Shan Kaye is not the real culprit.

Aldave said that Shank was genuine person and had no connection with such frauds. He just relied on his ex-lawyer’s representation and cannot make the difference between the validity of the credentials related to the purchase of Condomium. This was because the documentary stamp taxes as well as capital gains were duly paid. The receipts were shown as proof in the Court which clearly showed that all the formalities were correct and it all occurred due to misguidance of the formal attorney of Shank.

Finally, Aldave confirmed the reporters that he and his client will try their level best to let people and the legal authorities know about the real fraud. They are still waiting from summon which will be issued by the Department of Justice.

Aldave is sure that his client is at no fault and this all will end soon with favorable judgment.
