How to Deal with the Turkish Divorce Procedure

If you are a foreigner having problems with your marriage and thinking of getting a divorce in Turkey, hiring a lawyer is a must. Divorce is never easy—and it is even more complicated if you are in a foreign land.

The first thing you need to do is to look for a firm that provides legal services to foreign nationals. English is not widely spoken in Turkey, and this can be problem for foreigners who need legal representation. But don’t worry—you can find lawyers that are fluent in English.

Another factor you should consider is the lawyer’s specialization. If you are seeking a divorce, then you need an attorney who is experienced and qualified to practice family law.

To be able to get a divorce, your marriage must be registered under the Turkish vital statistics office. If the proper registration procedure was obtained for the divorce, you may then go to a Turkish civil court and receive court divorce decree. A Turkish lawyer is required to represent you in court through a power of attorney.

You have an option to choose a private trial instead of a public one. Ask your lawyer which option will be better for you. In Turkey, there are 2 types of divorce. A ‘contentious divorce’ is when a spouse goes to court to end the marriage due to conflicts like mental illness or adultery. The other type is ‘uncontested divorce,’ where a spouse wants to end a marriage and the other party has no objections. The judge will determine what will happen to you and your spouse. You may be given a reconciliation period of one to three years. Depending on the approval of the judge, the woman may (or may not) keep the ex-husband’s surname. Take note that women are not allowed to get married for a year after the divorce. You should also factor in child custody, which can complicate matters.
