Some Important Aspects of the ESI Act

After Independence, the government felt the need for protecting the interests of the workers, who otherwise could have been exploited by their employers. Hence, the Employees State Insurance Act came into being in the year 1948. This act encompasses an insurance scheme for providing coverage to employees in case of sickness, maternity, and disablement. Medical Benefits
This is the primary purpose of the act, which includes providing free treatment to the insured persons and their dependants. They are entitled to receive comprehensive treatment at ESI clinics & Dispensaries, government hospitals, and diagnostic centres. They are also eligible to avail Superspeciality treatment from the hospitals enlisted in the scheme. The scheme covers all kinds of sickness for the beneficiary and his/her dependants.
Identity Cards
As soon as the declaration is submitted by the employer, a Temporary Identity Card is issued to the insured person. This Temporary Identity Card bears the Insurance number and a photograph of the beneficiary along with the details about himself and his family. The insured person can avail the benefits of the scheme by displaying the Temporary Identity Card at the hospital or clinic. This card is valid for three months. At the end of that period, the concerned authorities issue a Permanent Identity Card. In case the Permanent Identity Card is not issued due to any reason, the temporary one gets renewed for another three months.
No Dismissal
The act also provides job security to the insured individual. According to Section 73 of the Act, the employer cannot dismiss, discharge, or in any other way punish an employee, during the period of his absence arising out of sickness or maternity. Further, the employee cannot be relieved of his/her services during disablement leave. This element was added to the scheme so that employers could not take undue advantage of the absence of the insured employee.
