Taking up a job in the United Arab Emirates can be a very challenging task. The economic crisis that has affected all, worldwide, has reduced the number of available jobs but people still rush to Dubai for better job prospects. Before you head to the Emirates for lucrative vocational deals make sure you educate yourself on the intricacies of Labor law and are mentally prepared to face the stiff competition for a job.

A credited and licensed company should be chosen in the UAE for employment reasons. These Ministry approved companies, appoint expatriates with entry permits or labor cards allowing these people employment and also residence visas. The visas and entry permits are handed out after careful screening of all the valid and important documentation.

Labor law in the UAE is enforced by the Ministry, equally for all emirates of the Federation. The local and Federal courts in the UAE decide the Labor related litigations but all the labor matters are initially taken to the Ministry for perusal. If they are unable to deal with the labor law UAE issues they pass it on to the Federal, local courts.

The Federal Law No. 8 on Regulation of Labor Relations for the year 1980 regulates and governs the private sector employment relations. Registration procedures like residence visa in case of foreign workers employed in UAE need company sponsorship and work permission. If these prerequisites are not satisfied then article 13 of Labor Law, insists the employer to obtain these permissions from the Ministry of Labor.

The "home-country" rights that every person headed to Dubai has seen in the past, is vastly different from the ones they will see in Dubai and the UAE. This knowledge is imperative to protect you from any kind of pitfalls. It’s not an easy job to change occupations as many employers demand a security and take the employee passports so that the owners can impel them to stay put at work. Arabs and Europeans enjoy the higher side of the wage scale whereas the Asians may have to lose out here. The amount of pay for the employee depends on his or her nationality and this, needs to be understood. No minimum wages and no anti-discrimination policies in the UAE, will take the new employees by surprise, but that is the way the labor law UAE works.

If the labor contract is not in line with public interest or if it is against the UAE labor law then it can be held invalid. The labor law deals with salary, gratuity, notice period and probation period of employees. The Federal law of 1980 insists that the employee probation period should not exceed 6 months.

When the labor contract is terminated by the employee after the probation period then the Labor law permits him or her, unpaid salary, annual leave, payment for extra hours, gratuity, notice period salary, air ticket and adequate compensation for unfair dismissal from duty, but all these rights are not valid if the termination of the contract is within the probation period. In this case the employee gets charges for extra work hours, unpaid salary and the air ticket back home.
