How to set up Tiffin Service Business?

Tiffin service India or dabbawallas are quite popular amongst students, office goers, bachelors staying alone and even families as it’s a convenient option of having nutritious three meals a day rather than cooking by oneself. In India, food operators operate this business commercially from their homes and even a dedicated office space. In order to run a Tiffin service business in India, the operator needs to get the following necessary registrations and licenses:

Registrations

a. Certificate of Incorporation from the Registrar of Companies under the Companies Act, 2013.

b. GST certification for obtaining the GSTIN for being able to submit taxes and file returns.

c. MSME registration for getting the Udyog Aadhaar number – a registered firm is entitled to lots of government subsidies and benefits.

d. Register under the Shop and Establishment Act. Once the certificate is obtained it needs to be displayed at the registered office of the service provider.

e. Register with the State Professional Tax authorities, the Employee State Insurance (ESI) authorities and Employee Provident Fund (EPF) authorities for tax-related issues and medical and other benefits for employees.

Licenses

a. It is mandatory to obtain Food license from the Food Safety and Security Standards of India. The state license from FSSAI is applicable for all dabbawalas who are earning between Rs. 12 lakh to Rs. 2 crores on a yearly basis. The application for this license can be done online by filling in Form-B. The license can be obtained for a period ranging from 1 to 5 years. The fees applicable for Tiffin services are Rs. 2000 per year. The documents that need to be submitted by the service owner are:-

  • List of the owner with his contact details.
  • Aadhaar card and pan card of the owner.
  • Ownership proof of the premises in the form of utility bills or rental/lease agreement
  • Partnership Deed/ Certificate of Incorporation
  • Food safety management system plan or certificate
  • Recall plan
  • No objection certificate from the Municipality
  • Form IX: Nomination of persons by a company along with Board Resolution

The license is granted only when the documentation is all properly done and the inspection report submitted by the Food Inspector after visiting the premises of the Tiffin service is found to be acceptable as per the FSS Act, 2006. The checklist followed while the inspection is the Catering checklist. The license along with the list of golden rules needs to be displayed at a visible position within the premises of the food operator during working hours. This is mandatory under the Food Safety and Standards Act. The display board is a means of conveying to the customers and food handlers about the hygiene standards that are required to be followed while in contact with food.

This license needs to be renewed before the existing license expires. The renewal process should be typically initiated 30 days before the expiry of the current one. During renewal, the Form-B again needs to be submitted, duly completed and signed by the owner or the authorized signatory. The other documents that need to be submitted during this process are the annual audit report; Food safety management plan; Form IX.

b. Trade License under the 11th Schedule of the Municipal Corporation Act 1957. The establishment can apply online or at the Citizen’s Service Bureau and submitted to the municipal corporation office.

c. No objection Certificate from the Fire Department. After installation of fire safety equipment, officials visit the premises and then issue the certificate.

d. No objection certificate from the Police Department

e. A NOC from the Society or Apartment where the Tiffin service is being provided.
