What is pardon and its type?

A pardon is a document which exempts someone from the punishment for a crime. The pardoning power is said to be an inherent right of the people where they can also vest the power in whatever they choose. The state constitutions spell out wherever the pardoning power lies. The pardons are said to be issued to individuals but it can also be issued to a group of people. Either made by the president or the state governor, the decision to deny or grant the pardon is said to rest mainly in the discretion of the executive. The decision is said to be typically final and is not said to be subjected to judicial review.

The decision to pardon an offender is a factor of public welfare and also if there is an unfairness which the courts cannot correct. The decision is not subjected to review or the oversight and there is no way of knowing as to what has factored in the pardon decision unless the governor or the President explains it. Pardon is such that it generally assumes that the offender is guilty of the offence and that, he has been rehabilitated. The president or the governor might deny the pardon to the offender that denies the guilt. Pardons are said to be revoked before they are delivered but it is not after they are delivered or accepted unless the offender had fraudulently obtained it.

Pardon effect is such that it symbolizes forgiveness for the crime but it does not wipe out guilt or expunge the conviction. This implies that if a person applies for a job, they should also disclose the conviction where they can also add that the pardon was granted. This also means that a court can consider the pardoned offences while deciding the punishment for future crimes.

What are the types of pardons?

There are different types of pardons and each of them has its own effect. The pardons can be partial or full, it can also be conditional or absolute.

  1. Full: This pardon is where it unconditionally absolves the person of the conviction and also of all the crime’s consequences.
  2. Partial: This only relieves the person from some of the crime’s consequences or punishment.
  3. Absolute: This parson is granted without any conditions
  4. Conditional: There are some conditions in it where it is fulfilled by the person who seeks the pardon and it occurs before the pardon takes something into effect. For example, the pardon can be such that it is conditioned on helping the police solve the crime or it might also include locating a suspect. There are some conditional pardons that become void when there is an occurrence of specified condition, for example, a former offender who commits another crime.
