The victim of crime compensation office, the Criminal Injuries Compensation Authority, is responsible for the administration of the Criminal Injuries Compensation Scheme. The Criminal Injuries Compensation Scheme was introduced to compensate innocent victims who suffer a personal injury as a result of violent crime.

Quite often, the offender responsible for a victim’s injuries does not have the means to financially compensate the victim which means that the victim will not receive the compensation they are rightfully entitled to for their suffering. If a court awards compensation to a victim when the offender is prosecuted, the victim will not necessarily receive the compensation award if the offender fails to pay. The Criminal Injuries Compensation Scheme is there to help provide some form of financial compensation as a way of recognising the personal injury that has been sustained by the victim and also as a way of expressing public sympathy for the traumatic ordeal they have experienced.

If a victim of violent crime wishes to instruct a solicitor to handle their application for compensation they are entitled to do so prior to applying to the Criminal Injuries Compensation Authority. The CICA currently deals with over 70,000 applications for criminal injury compensation every year and pays out, on average, £200 million a year to innocent victims of violent crime. The CICA will award compensation for a victim’s injuries based on the tariff of injuries and the level of injury that the victim sustained during the incident. The CICA will have to seek medical confirmation of the victim’s injuries prior to awarding compensation so it is important you visit your GP as soon as possible following the incident.

If a victim of violent crime is to be successful in claiming the compensation they deserve it has to be established that they were the innocent victim in a crime of violence. This means you will have to prove that someone else assaulted you and caused you to sustain a significant injury – if you can prove this the CICA will compensate you providing your injuries have a tariff value of the minimum award of £1000.

Victims who have been assaulted, attacked, abused or been subjected to any other type of criminal violence need to report the matter to the police and will need to obtain a crime reference number in order for the CICA to accept their application for compensation. If you fail to report the matter to the police within an appropriate time frame the CICA will not accept your application. In addition to reporting the incident to the police you then have to perform your public duty and assist the police in apprehending and prosecuting the offender responsible for your injuries – if the CICA establishes that you did not cooperate fully with the police they will withhold a compensation award.

There are a number of requirements you will have to fulfil if you would like the CICA to consider your application for compensation. It is strongly recommended you use a specialist solicitor to assist you with your application for compensation in order to ensure you are maximising your chances of making a successful claim. A specialist Lawyers will ensure that your application is sent, completed, to the CICA and will minimise the risk of any delays.
