What is MSO License and why you should care about it?

The world of entertainment has given us more channels that we could ever had hoped for. However, there is always more to research, more channels to come. What is MSO License and why you should care about it? Well, MSO License is an authorization to operate as an MSO. As for why you should care about it, there are multiple reasons:

  1. It provides you a way to establish a cable operating business.
  2. It allows you stand neck in neck alongside the players like dish and tata-sky.
  3. It allows you to create job opportunities in a country that has been badly hit by the recent pandemic.

Who is eligible for MSO License in India?

Following are the three types of applicants who can apply for MSO License in India

  1. Individuals.
  2. Associations.
  3. Registered Company.

If you are applying for MSO License as an individual, you should adhere to the following criteria:

  1. You should at least 18 years old.
  2. You should be an Indian citizen.
  3. You should possess a valid Aadhar card.
  4. You should have a valid PAN card.
  5. You should have more assets than liabilities (can’t afford to be an MSO if you don’t have money)
  6. You should not have any criminal history.
  7. You should have been declared of a sound mind by a competent court.
  8. While you can have a history of bankruptcy, you should not be a current bankrupt individual.

If you are applying for MSO on the behalf of a Trust or an Association, then the eligibility criteria is as follows:

1. The trust or association should possess one of the following documents:

a. Partnership deed

b. Trust registration certificate

c. Society registration certificate

d. Association registration certificate

  1. All the members of that trust or association should at least 18 years old.
  2. All the members of that trust or association should be Indian citizens.
  3. All the members of that trust or association should possess a valid Aadhar card.
  4. The trust or association should have a valid PAN card.
  5. The trust or association should have more assets than liabilities
  6. None of the members of that trust or association should have any criminal history.
  7. All the members of that trust or association should have been declared of sound mind by a competent court.
  8. The society or trust or association should not be a current bankrupt individual.

If you are applying for the MSO License on behalf of your Company, then the eligibility criteria is as follows:

  1. The company should be a registered business entity under the Companies Act 1956 or Companies Act 2013
  2. The company should possess a valid CIN (Corporate Identity Number)
  3. The company have more assets than liabilities (can’t afford to be an MSO if you don’t have money)
  4. The company should have a valid PAN card.
  5. The directors of the company should have a valid PAN Card.
  6. The directors of the company should not have any criminal history.
  7. You should have been declared of a sound mind by a competent court.
  8. While you can have a history of bankruptcy, you should not be a current bankrupt individual.
What is the process of MSO registration?

To file the MSO license, follow the steps as are given below:

  1. Go to broadcastseva.gov.in. Become a registered user and file the application for MSO registration. In case you have asked an MSO service provider to file the application on your behalf, you have to provide a certificate of authorization to him, signed by you, your co directors or the key members of your society/trust/association (depending upon the type of applicant.)
  2. Attached the required documents with the application.
  3. Download Undertaking form 2 and print it on a 10 rupees stamp paper. Send that undertaking to the ministry along with the hardcopy of the application, and the required documents.
  4. Submit the processing fee of INR 1 lakh on Bharat kosh and send the details of that to the Ministry as well.
What are the documents required for MSO registration?

To register MSO license, that documents that you’re required to submit are as follows:

1. For individual

a. Certified Copy of the Aadhar Card

b. Certified Copy of Certificate of Date of Birth

c. Certified copy of the PAN card

d. Certified Copy of the latest filled Income Tax Return

e. Copy of the Bharat Kosh Challan, the receipt of the processing fee you paid.

f. A duly audited Balance sheet and profit and loss statement

g. Net worth certificate signed by a Chartered Accountant.

h. Certified Copy of the undertaking on INR 10 stamp paper.

i. Copy of the authorization letter that empowers someone else to file the application on your behalf (if you are filing the application via an agent)

j. Copy of GST registration, if available

k. Copy of the Entertainment Tax Registration, if applicable in your area

2. For Society/Trust/partnership

a. Certified copy of Partnership Deed/firm registration/society registration/association registration/firm registration.

b. Certified Copy of the Aadhar Card of the members

c. Certified Copy of Certificate of Date of Birth of the members

d. Certified copy of the PAN card of the members

e. Certified copy of PAN card of the society/trust/partnership

f. Certified Copy of the latest filled Income Tax Return

g. Copy of the Bharat Kosh Challan, the receipt of the processing fee you paid.

h. A duly audited Balance sheet and profit and loss statement of the trust/society/partnership.

i. Net worth certificate signed by a Chartered Accountant.

j. Certified Copy of the undertaking on INR 10 stamp paper.

k. Copy of GST registration, if available

l. Copy of the Entertainment Tax Registration, if applicable in your area.

3. For a company

a. Certified copy of company’s Certificate of Incorporation.

b. Certified Copy of the Aadhar Card of the directors

c. Certified Copy of Certificate of Date of Birth of the directors

d. Certified copy of the PAN card of the directors

e. Certified copy of PAN card of the company.

f. Certified Copy of the latest filled Income Tax Return

g. Copy of the Bharat Kosh Challan, the receipt of the processing fee you paid.

h. A duly audited Balance sheet and profit and loss statement of the company

i. Duly audited Net worth certificate of the company signed by a Chartered Accountant.

j. Certified Copy of the undertaking on INR 10 stamp paper.

k. Copy of GST registration, if available

l. Copy of the Entertainment Tax Registration, if applicable in your area.
