How Naturalization is Different From Citizenship By Birth?

In the United States, immigration continues to be a common issue, due to the confusion between citizenship and naturalization. this not only confuses them but also frustrates them and makes the legal process more complex. Many people use citizenship and naturalization interchangeably. Both the terms are used by many as synonyms, however, the fact is that they both have very different meanings.

Both naturalization and citizenship are the terms that are highly essential to become a citizen of the U.S. it is possible to achieve citizenship in multiple ways. This can be done by having parents who are citizens, by being born in the U.S. or certain American territories, and by applying for naturalization. When someone wants to become a U.S. citizen, it is essential for them to know the key differences between citizenship and naturalization. U.S. Citizenship:-

The certificate of citizenship is given to the person who receives the citizenship through the parent who has U.S. citizenship. It is the status of being a citizen of a country. The certificate of citizenship is issued to the individual by the USCIS. It is issued to those who were born out of the country with parents or parents having US citizenship.

Naturalization:-

Naturalization is a process that involves several steps along the way. It is a popular process by which a foreign national become US citizens by going through the process of the naturalization process. Naturalization can only be achieved after the age of 18. The certificate of naturalization is granted to individuals who become an American citizens through naturalization. These certificates are issued by the USCIS to foreign nationals.

To be naturalized, it is essential for an immigrant to meet specific criteria. Such criteria include:

  • One must be a permanent resident of the U.S. for at least 5 years and should also meet all the rest eligibility requirements.
  • One must have qualifying service in the armed forces of the U.S. along with meeting the rest eligibility requirements.
  • One must be a permanent resident of the U.S. for 3 years or more. They should also meet all the eligibility requirements for filing as a spouse of a U.S. citizen.
  • The parents of the applier must be the citizen of the U.S. even if they reside currently outside of the U.S.

The applier can hire a lawyer for a USCIS interview, which is taken for naturalization. The lawyer can be hired without even informing the USCIS that you will bring someone with you as an extra guest, during the interview. The responsibility of the naturalization attorney during the USCIS interview is to hand a form called a G-28 to the USCIS officer for showing that he/she will represent you.

The rights of naturalized citizens are one of the most confusing areas of the naturalization process. As per the U.S. Constitution, whether the person is granted citizenship or naturalization, he/she is considered a citizen of the U.S. and has the same rights, like the right to vote and the right to obtain a U.S. passport. However, people with naturalization can never be deported. Such people also cannot revoke their citizenship at any time. Both citizenship and naturalization make a person the legal citizen of the United States and they both provide the same inalienable rights within the U.S. The main difference between these two is that the acquisition of citizenship involves giving the citizenship as a consequence of BEING something, while that of naturalization is giving citizenship as a consequence of DOING something.
