Can private industry do better than the government to ensure the appearance of defendants? To some, the answer is, no. The resources available to the government are so vast that private companies could not do a better job. Some would say, yes. Of course, a private company could. They would be beholden to their customers and would survive or die based on the quality of their work. Both are true to some extent. Bail happens to be one of those industries that have flourished as a private business separate from the government.
The entire point of bail is to ensure the appearance of the defendant. Bail ties the defendant to a family member or another loved one and increases the probability that the defendant will appear for their court hearing. When local governments outlaw bail or simply don't use it (release on own recognizance), the appearance rates plummet. Bail has an appearance rate of 95% to 98%. Pretrial release (or government-run programs) at the best show an 80% appearance rate for defendants. 80% is a generous number too. The defendant knows that no one is going to come and look for them if they do not appear while under pretrial release. That's because governments can't afford to dispatch police to find every single defendant who absconds. On the other hand, Bail Agents have a HUGE incentive to ensure the appearance of their defendant.
The bail bond system has been formally in use in our country since the late 1800s. It has evolved into a time-tested industry that quietly works with the criminal justice system to ensure that justice can be served. The bail bondsman wants the defendant to attend their hearing. It's in the terms of the bail bond that the defendant will appear. The money that is pledged in the form of the bail bond helps to ensure that the defendant's family or co-signer will show up to the hearing so justice can be served.
The Bail Company is financially liable as well as the co-signers who bailed the defendant out of jail. That means the co-signers check, bank account, cars, home, and investments could all be seized if the defendant fails to appear for court. No one wants to worry about a defendant not showing up for court. The defendant knows they will be in serious trouble if they do not show up to court.
The easy way to remember the difference between bail and pretrial release is simple. Pretrial release; no repercussions for the defendant and costs taxpayer money to track and monitor defendants who are released. Bail Bonds; almost always ensure the defendant will appear for court and allow justice to be served at no cost to the taxpayer.
