Why is having a personal injury lawyer important?
Posted: Feb 27, 2022
Having a personal injury lawyer is not only extremely important for those who have been injured from another's wrongdoing, but also for those who are looking to be compensated for their injury as well. Not having an attorney to support your case can lead you to lost money and time, as well as even halt your case before it has even begun! On the contrary, if you do have a personal injury lawyer by your side throughout this difficult time, you will see that they can help immensely with your case.
The first benefit of having a great personal injury attorney through this difficult time is that they know what they're doing! A Personal Injury Attorney will most likely have more experience than any other person in dealing with these types of cases because that's what they do! A personal injury lawyer is there for you to help fight your case, not just give you some money and walk away. Tampa personal Injury Lawyers are on their feet all day ready to battle for people's rights! If the case goes into litigation, a professional will absolutely know what they're talking about in the courtroom too.
A second benefit of having a Personal Injury Lawyer by your side is that if your case does go to trial, it will be much easier with an attorney on your team rather than trying to handle it yourself or solely through insurance companies. It would be absolutely insane to navigate through the legal system without any knowledge of how things work! The whole point of having a law degree is that one can represent themselves as well as others. An attorney is not just there for you, they're also there to help you. They know what steps to take and when they should be taken in order to create the best outcome possible for your situation.
A final benefit of having a Personal Injury Lawyer for your case is that they will never stop fighting until everything has been accomplished! A personal injury law firm won't stop until you are satisfied with the results at hand. Now, I'm not saying this for all personal injury lawyers because like every profession, some are better than others. However, if one does become your advocate throughout this process, they most likely have your back through anything else that happens as well!
Although having a personal injury lawyer may seem like an unnecessary cost right now, what your future holds may prove otherwise. When you think of all the possible outcomes that could happen, a personal injury attorney will truly be beneficial in nearly every circumstance! No matter what happens, having a Personal Injury Lawyer by your side will help you win the battle! Call us today for a free legal consultation to see how we can help you get what's rightfully yours from this unfortunate situation!
When should you hire an attorney after a car accident?
So you were in a car accident. Do you need to hire an attorney? There's really no simple answer to this question, but we can help guide you through it. Here are some things to consider:
1. How serious are your injuries and how much will they cost to treat?
If you're seriously injured then hiring an attorney becomes critical because of something called "no-fault insurance." Most states have a no-fault law on the books that requires all drivers within the state to carry personal injury protection (PIP). PIP covers medical costs regardless of who is at fault in the accident. However, many attorneys don't like representing clients with PIP coverage because there often aren't damages available for them to fully recover.
2. Do you have health insurance?
If not, and if the other driver carries liability insurance, then you may be able to make a claim against his or her insurer for your medical expenses. If so, this could potentially bring down the cost of hiring an attorney because they will likely take a much smaller fee than what they would typically request in full compensation for such injuries to cover their costs and time spent working on it. You can receive up to $10,000 in PIP coverage under most basic policies; if you're seriously injured then that's likely worth several thousand dollars right there (and sometimes more). Even if his insurance company doesn't want to settle right away and instead sends you through the process of filing a lawsuit and going to trial, the attorney's fees will be much more manageable.
3. Do you have health insurance?
If so, and if the other driver carries liability insurance, then you may want to consider hiring an attorney and filing a claim under your own PIP coverage (which you're paying monthly for anyway). This isn't allowed in every state but many allow it, and in states that do it can be a real money-saver because the attorney only needs to get paid once for all his or her time spent on such cases (instead of hourly like most states where such things are legal). However, this is usually not recommended unless...
4. You know what your injuries are worth.
If you don't know how much your injuries are worth, you need to hire an attorney ASAP! This is one area where attorneys can help immensely. If you can't go to the doctor for X-rays, MRIs, etc... because your back hurts too much do so it's not clear exactly what your injuries are then hiring an injury lawyer becomes critical. They will know how to properly diagnose all of your medical problems and advise on the best course of action--and this is before anything else even gets filed with the court.
5. What type of insurance do you have?
If you're uninsured or underinsured, things become more complicated legally but are usually still manageable through legal counsel. You want to make sure that if there are any damages available to recover they actually get collected.
If you're in this type of situation, don't just hire an attorney. Make sure they know how to handle such cases, or you might find yourself in a position where it's too late to hire one when the time comes.
6. Is the process simple?
If there are damages available for recovery and if your injuries are minor (or not so clear) then hiring an attorney can be more complicated than what it's worth; at the end of the day you will only get paid if they win or settle--and that could take months or years depending on how busy they are with other cases (and whether they agree to take yours on a contingency basis). If it becomes apparent that they cannot make treatment affordable for you for as long as it takes to resolve the case, then you will need to hire another attorney and restart the process.
7. What is your budget?
If your injuries are going to take a long time to recover from or if they're going to be really difficult for you financially then hiring an injury lawyer usually becomes a no-brainer because you'll want legal counsel helping you through such a complicated time in your life. However, even with medical expenses covered by your health insurance or PIP coverage, there can still be out-of-pocket costs associated with getting treatment that makes hiring an injury lawyer important for making sure all of those bills get paid--not just the ones related directly to your injuries. make sure you explicitly ask them if they handle such cases and what their success rates are.
If your injuries aren't serious or you can afford to travel to a doctor on your own then it's probably best that you try to do so--the costs of hiring an attorney will outweigh the benefits in most cases if your injuries are fairly minor. If there is any doubt about whether the other party was at fault for your accident, don't wait. Hire a Tampa car accident lawyer as soon as possible. Remember, even if they represent you free of charge until a settlement is reached it's going to be well worth whatever money you would have spent without them.
Your life becomes a masterpiece when you learn to master peace.
