Advocates in Kolkata Debating in Supreme Court

The advocates in Kolkata are looking for an opportunity to fight or debate a case in the Supreme Court which is the apex court and a lot of people appeal there to get the justice or for any other issue.

Any person who is studying law as an undergraduate course from a reputed law college in India must have a comprehensive knowledge and understanding of the Indian Constitution. A constitution is defined as the aggregate of laws and customs which form the scheme for the arrangement of power relationship inside the political community. The system of administration of the state is embodied in a document known as the Constitution. The Constitution of India is the largest written establishment with a Parliamentary or Cabinet system of Government having a Federal structure. The Parliament which has the right to frame the laws of the country has to do so according to the Constitution. All the citizens are expected to strictly abide by the laws and the one who fails to do so or does anything unlawful is tried in the court. It is then he needs the help of an advocate to present his case in the court.

The advocates in Kolkata should be familiar with the fact that in India there is an integrated and unified judiciary for the entire country which is organized pyramidally. At the bottom there are several Nyaya Panchayats which are basically found in the rural areas and at the apex there is the Supreme Court. In the between there are various other lower courts besides the High Courts in each State. The Indian courts of adjudication are usually categorized into two categories-Civil Courts and the Criminal Courts. The Courts that deals in general with disputes regarding land and property or any other family issue such as divorce between a husband and wife. On the other hand, those that deal with some serious and gruesome crimes such as murder, rape, arson, riot, extortion of money, loot and burglary are sorted out in criminal courts. The police has to produce the arrested culprit before the court where the judge decides his fate after the hearing is completed.

The Supreme Court of India located at the capital New Delhi was established according to Article 124 of the Constitution which says ‘There shall be a Supreme Court of India consisting of a Chief Justice of India and until Parliament by law prescribes a larger number of not more than seven other judges.’ However, the Constitution was amended under Act 22 and at present the number has increased to twenty five. It is known that it is the apex court and its judgement regarding any case is regarded as final and absolute. Any petitioner who has lost a case in the Supreme Court cannot file his case anywhere in any other court and has to agree to the verdict willingly or unwillingly. However, he has the right to approach the apex court for the second time for a review petition against the earlier decision.

Most of the people who want to become successful advocates in Kolkata in the future also want to become the lawyer of the Supreme Court. However, only an experienced and a senior barrister is entitled to debate a case in the Highest Appellate Authority in India.
