What Is Spousal Sponsorship?
Posted: Feb 15, 2023
The Canadian government allows Canadian citizens and permanent residents who are in a relationship with a foreign national to sponsor that person to join them and become a permanent resident of Canada. You can sponsor your spouse or common-law partner, or conjugal partner. You have two main options to choose from when sponsoring: Out land and Inland sponsorship.Sponsorship allows a person who is partnered with a Canadian citizen to obtain permanent residence in an easy and quick way with excluding language proficiency, education and work experience requirements like other categories.
Who Can Be A Sponsor?
- A Canadian citizen or permanent resident
- Must be 18 years or older
- Able to support the sponsored person financially;
- Have never failed to pay an immigration loan, a performance bond, or family support payments
- Legally married with the sponsor in the native country, (he/she do not need to marry in Canada but the marriage must be legal in the country where they got married).
- Must provide financial support for your partner for required years from the time they become a permanent resident.
- Must not be under a removal order
Who Can Be Sponsored?
The following relationships with a Canadian citizen or permanent resident are considered functionally equivalent under Canadian law for the purposes of immigration to Canada.
Spouse: To qualify as a spouse, you must be legally married to the sponsor. The marriage must have been considered valid when it was entered into under the law of the jurisdiction where you were married and under Canadian law, regardless of where you lived after you were married.
Common-Law Partner: You are considered a common-law partner under Canadian law if you have cohabited with your partner in a conjugal relationship for at least one year (12 consecutive months, not necessarily an entire calendar year). This 12-month period does not have to be absolutely continuous; short absences for business or family reasons are acceptable.
Conjugal Partner: The conjugal partner category is designed for partners who would have qualified under the spouse or common-law partner categories but were prevented from doing so by local law or other factors beyond their control such as an immigration barrier or marital status.
Fiancé: A fiancé relationship will not independently qualify you for sponsorship. This being said, many couples in such relationships already qualify for Canadian immigration under another eligible category, such as common-law partner sponsorship.
Parents & Grandparents: The sponsor can sponsor their parents and grandparents for migration through the PGP program. They wish to live in Canada and eligible for super visa.
Dependent Child: The sponsor can sponsor his/her dependent children, whether natural or adopted, to live with then as permanent residents in Canada.
How Many Spouses And Partners Does Canada Welcome Each Year?
Under its Immigration Levels Plan, Canada aims to welcome over 400,000 new immigrants per year. Some 60 per cent are targeted as economic class skilled workers, followed by family class immigrants, and refugees. Among family class immigrants, Canada seeks to welcome some 80,000 per year under its Spouses, Partners, and Children category.
