The MPCB has a number of procedures for obtaining this type of approval. These include a site plan, air and water noise analysis, soil sampling and soil analysis reports.
If the manufacturer wants to start a new factory in Maharashtra, they must first obtain permission from the MPCB. This will ensure that the company's operations won't pollute the surrounding area or contaminate the local water supply.
This process is important for all manufacturers who discharge or store substances like poisonous gases, wastewater, or noise, which could contaminate the surrounding environment. It also helps protect the health of people in the community.Consent to Operate
Any entrepreneur, industry, project or establishment which discharges sewerage, trade effluents or emits air pollution into the environment is required to obtain consent to operate from MPCB. This is done under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Rules, 1981.
For obtaining Consent to Operate, the industry/project proponents can apply online through MPCB's Online Consent Management & Monitoring System or submit a hard copy of the application form at all MPCB offices or through their state pollution control board's website. This application forms should be submitted in triplicate with an amount of DD in favour of Member Secretary, State Pollution Control Board.
It is important to remember that if a company does not get consent from MPCB for their manufacturing, production or any other operation they face a fine of 10 times the consent fee. This can vary depending on the capital investment of the company.Renewal of Consent
As of late, MPCB have started a new procedure by which a company can fill and present their consent to Establish, operate or renewal of existing consent online. The applicant needs to provide his email ID and PAN card of the Company.
Once the application is successfully completed, the MPCB authority inspects it and checks that all the conditions are met. Then they grant the consent.
Under the provisions of Water (P & CP) Act, 1974 and Air (P & CP) Act, 1981, any industry or process discharging effluent into water resources or polluting land/air is required to obtain the consent from the State Pollution Control Board.
Similarly, any industry or process generating, storing, transporting, disposing or handling hazardous waste as defined in the Hazardous Waste Handling and Management Rules, 1989, as amended in 2000 is also required to get the authorization from the MPCB. After the consent has been issued, the industry is required to renew it on a regular basis.
