The idea of single-parent surrogacy in India is becoming more common as individuals choose to build families independently. However, despite growing demand and social acceptance in many parts of the world, India has taken a strict legal stance on who can access surrogacy.

If you are a single intended parent considering India, it is crucial to understand the current laws and, more importantly, explore safe and legal international alternatives where single-parent surrogacy is possible.

Is Single-Parent Surrogacy Allowed in India?

The short answer is no.

Under the Surrogacy (Regulation) Act, 2021, surrogacy is permitted only under very specific conditions. The law clearly states that:

  • Only heterosexual married couples are eligible

  • The couple must be married for at least 5 years

  • They must provide medical proof of infertility

  • The surrogacy arrangement must be altruistic

This automatically excludes:

  • Single men

  • Single women

  • LGBTQ+ individuals

  • Live-in or unmarried couples
