When someone writes a song, then the song will be copyrighted to him or her at once when they are in the tangible form. It is important to register the songs before it is released to the public.
If you are the owner of the copyright, you will be the one with the rights to reproduce and to resell your music track. You are also the one to create the variations and the derivatives for the song and to distribute or to perform it on the public. If you are the one who recorded the song like an artist, then you will also hold the copyright for the recording.
If you give a person, the right to the license, then it means that you are giving the person the right of using the music theme. Sometime the writer may need to transfer the copyright to the publisher. This is called assignment and transfer of the copyright to the publisher. However, the publisher will have to exchange the payment to the writer in terms of the royalties after sometime. Normally the copyright of the song can be with the music publisher and the sound recording will be controlled by a recording company.
The songwriter and the recording artists will not get equal royalties. The recording artists get involved into the commercial music by selling their music in different forms such as the cassette tapes and CDs. However, these people will not get the royalties if the song is played on the TV or radio since this is the way to increase the number of the people who buy the CDs or tapes. However, the publishers and songwriters will get the royalties in such cases and they also get a certain percentage when there is a recording sale.
