Careless driving has been the most common violation which you will be noticing in any country. There are various laws and acts which state under particular conditions you will be fined. As of Scotland, following are the rules and regulations for careless driving under section 3 of the Road Traffic Act 1988 the prosecution require proving one of two things:

(a) That the accused driver drove without due care and attention and/or

(b) That the accused driver drove without reasonable consideration for others using the road or place.

What is Careless Driving?

The definition of"careless driving" is contained within section 3 of the Road Traffic Act (RTA) which defines careless drivers as"those who drive a motor vehicle on a road in a manner that falls below what would be expected of a competent and careful driver" or"’those who drive without reasonable consideration for other persons using the road or place".

To be classified as a careless driver it is essential that the police authorities come to know that the driver did not exercise the level of care in the surroundings which was needed while he/she was driving. This can happen in many situations whether an accident has taken place or not. If you are caught under this act then you will have a demerit of 3 – 9 points which is a hefty penalty which will in future either lead to suspension of your license if such cases occur. This will result in frequent meetings with the authorities who will be questioning you regarding whether you are allowed to keep your license or not.

Apart from penalties, the other part which will be affected is your insurance. Insurance companies take severe actions against those who have been penalized. Insurance companies have their own ways of charging but one thing that is assured is that if the number of points increase on your list then the insurance company will not renew your policy and you will have to find other options.
