How To Register A Logo In UAE?

The law guiding Logo registration in UAE is the trademark law of the land. The original trademark law in UAE was formed in 1992, referred to as Federal Law No. (37) of 1992. This law has been amended twice to enhance the protection it offers. The first time it was amended was in the year 2000 as law no. (19) and later in 2002 as law no. (8).

All the affairs related to the trademark registration of a logo in Dubai are seen by the ministry of economy of UAE. Once a logo is registered by the ministry, it is valid in all the seven emirates of UAE. The application for registration of a logo along with all the requisite documents must be submitted to the ministry, of course aligning with the provisions of the trademark law.

Upon receiving the application and the related documents, the ministry of economy scrutinizes the documents thoroughly. They take a maximum of thirty days to announce their decision. If the registration is approved the decision is published in at least two Arabic newspapers and the official bulletin of the government.

Following this announcement, anybody can file an objection to the registration within thirty days from the last date of the announcement. The objection maybe filed in person, through email or through register mail to the ministry of Economy. Now, it becomes the duty of the ministry to notify the applicant about the objection within fifteen days of the receipt of the objection. Upon clarification of objections or in cases where there is no objection to the registration of a logo, the ministry registers the logo. A certificate is issued to the applicant on registration of the logo, the certificate all relevant details like the registration number, the name of the logo owner, the date of application, the date of registration, copy of the logo and all related description.

The protection offered by the trademark law of UAE is for ten years. The trademark or logo owner must apply for the renewal of the protection in the last year of the protection. Upon receiving the application and all the required documents the ministry of economy further offers protection for ten years.

The infringement of the trademark law attracts fine and or imprisonment. The articles (37) and (38) of the law contain in detail the penalties for the infringement of the provisions of the trademark law.

The trademark law of UAE empowers the ministry of economy with the right to cancel the registration of a trademark. In such a case the ministry has to specify the reason(s) to the owner of the trademark and also must listen to the arguments of the owner. The owner of the trademark has the right to appeal in the court of law within 30 days of receipt of such a notification.

The government has taken these initiatives for the protection of the rights of the businesses as well as consumers.
