The law of the trademark registration in dubai defines trademark as "a trademark is any distinguished form of names, words, signatures, letters, figures, graphics, logos, titles, hallmarks, seals, pictures, patterns, announcements, packs or any other marks or group of marks if they were used or intended to be used either to distinguish goods, products or services from whatever sources or to indicate that certain services, goods or products belong to the owner of the trademark because of their provision, manufacturing, selection or trading. Right from the definition of a trademark, trademark registration process and requisites, transfer of trademark ownership, cancellation process, penalties for the infringement of a registered trademark and more is included in the law. After the inception of the law in 1992, the trademark law or Federal Law no. (37) Of 1992 was amended in 2000 by the Law no. (19) Of the year and again in 2002 by Law no. (8) Of the year.
Simple registration process
To give a boost to the economy it is necessary to make the official procedures simple and this is what the government has done in UAE. The registrations of trademarks fall under the control of Ministry of economy in UAE. A fully filled application along with the requisites defined by the law must be submitted with the ministry of economy. The ministry scrutinizes the documents and examines the application carefully and arrives at a conclusion within 30 days of the submission of the application. On approval of the trademark, the ministry declares it in two Arabic newspapers and the official bulletin of the ministry.
Now, if anybody has an objection to the announcement of a trademark registration, the objection must be filed to the ministry of economy within 30 days from the last date of the announcement in the official bulletin. The individual/company who had applied for the registration of the trademark is then notified by the ministry within 15 days of the receipt of the objection(s).
Upon successful registration of a trademark, a registration number and a certificate is issued to the owner of the trademark. Once a trademark is registered in UAE, it is valid for ten years in all seven emirates. After the completion of ten years a renewal application along with the official formalities and the prescribed fee can help in extending the validity of the trademarks for ten more years.
