If you are a businessman and you are thinking about establishing a presence within the United States then you will probably want to be able to live in the control so that you can control and direct your business ventures. And if that is the case then you might be a good candidate for the special E2 investor Visa. Better known as the E-2 Treaty Investor Visa, this type of Visa is arguably one of the fastest growing in popularity among all the Visa types and that may be because most people are only just finding out about its existence. It is a special type of Visa that was created to invite big investors to invest into the US economy and help it grow.

Qualification for the E2 Investor Visa

The qualification criteria are not exactly what you would expect for a typical American Visa, and most people have expressed feelings that it is almost discriminatory to business people from specific countries. However, as things remain at the moment then people from specific countries will still not be able to apply for this type of Visa. And that is just one of the qualifications. Others in the criteria for qualification include;

  • You must be from a country that has an existing commerce and navigation treaty with the United States. The US immigration Departments usually provide a full list of countries with such treaties and the list is normally upgraded on a regular basis so you should check and make sure that your own country appears in that list before you submit an application for this type of Visa.
  • The individual applying and/or the business must have nationality of the treaty country- this means that the funds that are to be invested in the US under arrangements of this Visa must originate directly from one of the listed treaty countries.
  • Applicant should have already invested in the US or should be actively investing already- you do not apply for an E2 investor Visa before you actually take active investment steps in the country. Actively investing, in this context, means that by the time of your application you have already gone through some of the basic preliminary steps of investment such as incorporating your business in the US, leasing office space or purchased equipment and started recruiting staff.
  • Applicant must be operating a non- marginal enterprise- you cannot
apply for an E2 investor Visa if you plan on running a marginal enterprise i.e. a business that can only make enough money to support the investors and their families. The business must have capacity to contribute to the American economy as a whole.

  • Applicant must have a substantial investment in the business- although the regulations do not exactly set a minimum, it is generally clear that business with investments of $200,000 or more stand a better chance than those with less.
  • Applicant must demonstrate that their physical presence in the US is vital for the operation, profitability and growth of the business into which they are investing.
