Deportation - How to defend yourself
Posted: Oct 03, 2019
When you are told that you are going to be deported you may get very stressed out, frightened or disturbed. Just imagine that you have made yourself a life in another country and met people that you love, suddenly, you are told by the government that you can no longer stay and must be deported for whatever reason.
Before stressing out, it is very important to understand why you of all people are facing such a problem. If you have done nothing wrong and have all of the necessary documents ready to prove that you are in the UK legally, you have nothing to worry about. However, if you do not have everything organised some of the top immigration solicitors London state that there are some ways to prove that you need to stay.
Seeking asylum in the UK
Seeking asylum is only possible in some cases as it includes you escaping from your home country as result of violence, danger, or political persecution. Many countries in the western world including the UK can grant you asylum after a thorough background check is carried out. It is important to speak to a human rights lawyer about your options.
Proving your innocence to the courts
Another possible reason to be deported is because of criminal activity that you have taken part in. If you’ve committed a crime and are being threatened with deportation you need to hire a lawyer straight away in order to prove innocence. If you are successful in the criminal trial, the removal order will be lifted against you. As any court order, such a path can take a lot of time but you if you have done nothing wrong it really does not matter how long the trial takes, you will be able to remain in the UK for its entirety, as long as you have been in the country on a valid visa before the charge was put against you.
Being an active member of the community
If you are going to be deported, you may find a way of staying if you can prove that you have been in the country for many years. If you are married to a local and/or have a child, you could have the courts drop the deportation order against you. For more advice ask an immigration lawyer about how to proceed.
Applying for legal status in the UK as a Spouse
If you are married to a British citizen or someone with indefinite leave to remain, you can follow the deportation order and leave the country and then in your home country, apply for a UK Spouse Visa so that you can legally return to the UK in the near future as a spouse. You can also do this within the UK if you already have a valid visa and plan ahead, i.e. apply a while before your visa expires and as long as your visa allowed you to have leave to remain in the UK for more than 6 months.
