The People’s Republic of China (PRC) is modifying its immigration laws to make the immigration process more comprehensive. A new exit-entry administration law (EEAL) and new state council regulations became effective in 2013. These new laws and regulations have made changes to many processes regarding visas, entry & exit, residence, stay, penalties, and deportation.

Different types of visas can be issued by the embassies, consulates and other visa issuing agencies outside of Mainland China. In some special circumstances the public security bureau (PSB) at a port of entry is authorized to issue a single-entry visa which is valid for 30 days or less. Entry-exit office of the PSB is also authorized to issue visas to extend the stay or even change the purpose of stay in Mainland China. As a part of the visa application, an interview is required at a Chinese embassy or other visa issuing agencies abroad. Residence permits are issued to those individuals who are applying for the residency in China. These visas include J1, Q1, S1, X1, and Z types and are valid only for a single entry to China. These individuals are required to apply to a PSB exit-entry office for a residence permit within 30 days of entry in China. Instead of visa, this issued residence permit can be used to enter China.

There are certain individuals, who are issued stay certificates rather than a visa or a residence permit. It can be given to an individual whose government has a reciprocal visa waiver agreement with China. Also, individuals travelling through certain cities within 72 hours can be given a stay certificate. Other circumstances under which a stay certificate can be given are when a person renounces PRC nationality, if the residence permit has been cancelled and the person wishes to stay for 30 more days, if a person’s visa or residence permit has been cancelled or confiscated and order has been issued to leave China by a certain date.

Different types of visas are given for different purposes. A C type visa is given to the foreign crew members and to their accompanying family members. A D type visa is given to individuals who would like to stay permanently in China. If you are visiting China for exchange programs, visits or study tours then you must apply for an F type visa. A J1 visa is given to foreign journalists who intend to stay for more than 180 days and J2 if the stay period is less than 180 days. For tourists an L type visa is required. For visiting your family members who are Chinese citizens or permanent residents, a type Q1 visa is required if the stay period is for more than 180 days. For stay period less than 180 days, Q2 visa is required. If you want to study in China for more than 180 days, an X1 visa is needed. For duration less than 180 days an X2 visa is required. For those who want to work in China, a Z type visa is required.
