  • Skills in Demand (formerly TSS 482 visa) – DAMA / Labour Agreement stream

  • Skilled Employer Sponsored Regional (SESR) / 494 visa under DAMA conditions

  • Employer Nomination Scheme (ENS) / 186 visa via DAMA, for permanent residence in many cases

For many DAMA-endorsed occupations, there is a direct or conditional path to permanent residency after fulfilling the visa conditions for a certain period.

  • Must operate within a designated DAMA region and be endorsed by the region’s Designated Area Representative (DAR)

  • Must demonstrate that they have attempted to recruit locally (labour market testing) and cannot find suitable Australian citizens or permanent residents to fill the role.

  • Must be an ongoing viable business, with no history of violating employer obligations.

  • For each nomination, must offer wages/terms consistent with local standards (or within approved concessions) and comply with all relevant employment laws.

For Visa Applicants
  • Must be nominated by an approved employer under a valid DAMA labour agreement.

  • Occupation must appear in the relevant DAMA occupation list and head agreement.

  • Meet minimum English, qualification, and work experience requirements—though concessions may apply under the specific DAMA.

  • Acceptable age (often raised under DAMA allowances) and health / character criteria.

How the Application Process Works
  1. Employer obtains DAR endorsement: The employer applies to the DAR for endorsement to access the DAMA, proposing the occupation(s) and providing evidence of need.

  2. Employer submits labour agreement request: Once endorsed, the employer negotiates and lodges a labour agreement (or variation request) with the Department of Home Affairs under DAMA terms.

  3. Nomination & visa lodgement: With the labour agreement in place, the employer nominates the overseas worker for the position, and the worker lodges the visa application.

  4. Fulfill visa conditions / pathway to PR: After working under the visa conditions for the required period, the worker may be eligible to apply for permanent residency under ENS or SESR, depending on the occupation and DAMA provisions.

Processing times, application fees, and specific documentation may vary depending on the region and the occupation.

Challenges & Considerations
  • The DAMA program is region-specific, so eligibility depends strictly on whether the employer and the job are within the designated area.

  • Not all occupations on the standard skilled occupation list are covered; some may still be excluded or subject to caps.

  • Even though concessions exist, applicants still must meet minimum standards of health, character, and baseline criteria.

  • The employer must continue to meet obligations to employees and maintain compliance throughout the labour agreement period.

  • There may be caps on how many overseas workers can be sponsored under each DAMA per year.
